Customer Terms of Use

These Customer Terms of Use (the "Terms") are an agreement between you and HomeMaxx Franchising, LLC ("HomeMaxx", "we", "us"). They govern the HomeMaxx website at homemaxx.pro, Ask the Pros and the rest of Learn, the customer portal, warranty documents, and the texts and emails we send (together, the "Services"). By using the Services, asking a question, submitting a request, messaging a Pro or clicking to accept, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. Contractors and franchisees are governed by separate terms they accept inside HomeMaxx Pro.
1. Who we are and who does the work
HomeMaxx is a franchisor and a software platform. HomeMaxx franchises are independently owned and operated businesses ("HomeMaxx Pros" or "franchisees"). HomeMaxx Pro, the platform, is also licensed to contractors who are not franchisees ("independent contractors"). Franchisees and independent contractors are together "Contractors" or "Pros". Any estimate, contract, work, warranty, invoice or payment is between a customer and a Contractor. HomeMaxx does not perform home services, is not a party to that contract, does not employ Contractor personnel, and does not guarantee the quality, safety, legality, licensing, timing or outcome of any work.
Contractors are solely responsible for their licenses, permits, insurance, employees, pricing, advice and workmanship. "Verified by HomeMaxx" means HomeMaxx checked a Contractor's business entity, trade license, insurance, warranty pledge and reviews at a point in time and re-checks them yearly. It is a check of the business's bona fides, not a guarantee of their work or a recommendation for your particular project.
2. Requests for service and consent to be contacted
When you submit a request through Get a Pro, or reach out to a Pro from Learn, you confirm that the information is accurate and that you are authorized to request work at the property. You agree that HomeMaxx and the Contractor matched to your request may contact you at the phone number and email you provided about that request, including by calls and text messages, which may be sent using automated dialing or texting technology. Your consent is not a condition of buying anything. Message frequency varies; message and data rates may apply. Reply STOP to any text to opt out, or HELP for help. Opting out of texts does not opt you out of calls or emails, which you may stop by telling the sender.
Requests inside a Contractor's territory go to that Contractor. Outside any territory, requests are offered to nearby Contractors in the trade in turn. If you are already a customer of a Contractor, that Contractor may continue to contact you about your existing relationship as permitted by law.
3. Ask the Pros, Learn and conversations with a Pro
Questions you post on Ask the Pros are public and may be shown, edited for length, moved to a different trade, or removed at our discretion. Do not include names, addresses, phone numbers or anything you would not want published. Answers are general information from independent contractors based on what you described, not an inspection of your home, and not professional, legal or safety advice; a Contractor who looks at your home may see it differently. Glossary entries, guides and links to other websites are provided for education only.
When you message a Pro from their answer, the conversation is private between you and that Contractor, and HomeMaxx stores it to provide the Services. A small file on your device (a cookie) identifies you to your conversations; clearing it ends your access to them. Anything you choose to share in a conversation, including your name, contact details and address, is shared with that Contractor, who may add you to their customer records and contact you about it. Contractors are independent businesses; HomeMaxx is not responsible for what they say or do.
You may mark an answer as helpful. Do not use these features to advertise, harass, impersonate anyone, or post content you have no right to share.
4. Customer portal, warranties and electronic documents
The customer portal lets you view and approve estimates, view and pay invoices, follow an appointment, view your warranty and make a warranty claim, and message your Contractor. Access is by a one-time code sent to your phone or email; you are responsible for keeping that phone and email secure. By approving an estimate or signing electronically, you agree that your electronic action is your signature and has the same effect as a handwritten one, and you consent to receive documents electronically.
Payments made through the portal are processed by Stripe on behalf of the Contractor; HomeMaxx does not hold your funds. Warranties are issued by the Contractor on the Contractor's own terms; the HomeMaxx standard warranty document describes the minimum a Verified Pro has pledged, and claims are made to the Contractor through the portal. HomeMaxx is not the warrantor.
5. Acceptable use
You agree not to:
- submit fake or fraudulent requests, questions or franchise inquiries;
- upload unlawful, infringing, defamatory or malicious content, or content you have no right to share;
- scrape, crawl, copy or resell the Services, or use automated means to access them beyond what a browser does;
- attempt to access another person's conversations or data, defeat security controls, or overload the Services;
- impersonate anyone or misrepresent your relationship to a property.
6. Content and intellectual property
The Services, including the HomeMaxx and HomeMaxx Pro names and logos and the Verified shield, are owned by HomeMaxx or its licensors. You keep ownership of content you submit and grant HomeMaxx a worldwide, royalty-free license to host, process, display and transmit it as needed to provide the Services, including publishing your questions and helpful marks. You represent that you have the rights to grant that license.
7. Reviews and feedback
If you leave a review or rating, it must be honest and based on your own experience. We may display, edit for length or remove reviews at our discretion. Feedback you give us about the Services may be used without obligation to you.
8. Third-party services
The Services rely on third parties including Stripe (payments), Twilio (texting), Resend (email), Google (sign-in, maps and reviews), Intuit QuickBooks and Xero (accounting, at a Contractor's election), OpenFreeMap and OpenStreetMap (maps), RainViewer and the National Weather Service (weather), the U.S. Census Bureau (ZIP data) and hosting providers. Their terms apply to your use of their services. HomeMaxx is not responsible for third-party services.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEMAXX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ANY WARRANTY ARISING FROM COURSE OF DEALING. HOMEMAXX DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY CONTRACTOR WILL BE AVAILABLE OR WILL PERFORM.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEMAXX AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR ANY WORK PERFORMED BY A CONTRACTOR. HOMEMAXX'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
11. Governing law and dispute resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its rules, seated in Melbourne, Brevard County, Florida, before a single arbitrator. Either party may instead bring an individual claim in small-claims court. YOU AND HOMEMAXX EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Contact us at legal@homemaxx.pro before starting arbitration; we will try to resolve the matter within 30 days.
12. Changes
We may change the Services and these Terms. We will post the updated Terms with a new version date at homemaxx.pro/terms. Continued use after a change means you accept it.
13. General
These Terms and the Privacy Policy are the entire agreement between you and HomeMaxx about the Services. If any provision is unenforceable, the rest remains in effect.
