This Privacy Policy explains how HomeMaxx Franchising, LLC ("HomeMaxx", "we", "us") collects, uses and shares personal information through homemaxx.pro, the HomeMaxx Pro application, the customer portal, and our messages (the "Services"). It applies to homeowners who request a Pro, to prospective franchisees, and to the contractors and staff who use HomeMaxx Pro. HomeMaxx franchisees and other contractors using HomeMaxx Pro ("Contractors") are independent businesses and are responsible for their own privacy practices when they use your information.
1. Information we collect
We collect information you give us, information generated by your use of the Services, and information from Contractors and service providers:
- Request details: name, phone, email, service address, ZIP code, the trade you need and what you tell us about the job; whether you consented to be contacted and when.
- Franchise inquiries: name, contact details, market of interest, background and capital range, and the documents and signatures you provide during the franchise process.
- HomeMaxx Pro accounts: name, email, phone, profile photo (from Google if you sign in that way), job title, company details, and your activity in the app.
- Company business data entered by Contractors: customers, properties, estimates, jobs, schedules, invoices, payments, messages, notes and management (BOSS) records. This includes personal information about the Contractor's customers, which the Contractor controls.
- Portal use: one-time codes sent to your phone or email, the estimates you approve, invoices you view or pay, and messages you send.
- Location: a technician's live location while en route to an appointment (shared with the customer for that visit only) and the approximate location of service addresses.
- Payments: handled by Stripe. We receive payment status, amounts and the last four digits of a card, never the full card number.
- Technical data: IP address, browser and device information, pages viewed, referring pages and UTM tags, timestamps, and cookies or similar identifiers.
- Communications: the content and metadata of texts and emails sent through the Services, including replies and opt-outs.
2. How we use information
We use information to:
- match your request to a Contractor and let that Contractor contact you about it;
- send the messages you have consented to, including appointment, estimate and invoice notifications and follow-ups, and honor opt-outs;
- provide, secure, support and improve HomeMaxx Pro and the customer portal;
- process payments, lead fees and royalties, and keep accounting and audit records;
- evaluate and communicate about franchise inquiries, including delivery of franchise disclosure documents;
- detect fraud and abuse, enforce our Terms, and comply with law;
- analyze usage in aggregate and, with your consent where required, market our own services.
3. How we share information
We do not sell personal information. We share it only as follows:
- With the Contractor matched to your request, or whose customer you are, so they can serve you. Contractors use your information under their own policies and the law.
- With service providers that process data for us under contract: Stripe (payments), Twilio (texting), Resend (email), Google (sign-in), Vercel and Supabase (hosting and databases), Nominatim/OpenStreetMap (address lookup and maps), and similar vendors.
- With accounting systems (QuickBooks Online, Xero) only when a Contractor connects them, and only the Contractor's own business records.
- Within the HomeMaxx family, including our parent Adroit DRX, LLC, for the purposes above.
- To comply with law, legal process or government requests; to protect rights, safety and property; or in connection with a merger, financing or sale of assets, in which case this policy continues to apply.
4. Text messaging
Mobile phone numbers and text-messaging consent collected through the Services are used only to send the messages you agreed to receive and are not shared with third parties or affiliates for their own marketing purposes. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help. Carriers are not liable for delayed or undelivered messages.
5. Cookies and analytics
We use cookies and similar technologies that are necessary for the Services to work (sign-in sessions, security, the customer portal, remembering choices). We may use privacy-respecting analytics to understand how the Services are used. You can control cookies through your browser; disabling necessary cookies will prevent sign-in.
6. Retention
We keep information for as long as needed for the purposes above: requests for service and consent records for as long as the matched Contractor's relationship with you lasts plus the period required to document consent and defend claims; company business data for as long as the company's account is active and for a reasonable period after; payment, royalty and audit records as required by tax and franchise law. Contractors can archive or delete records in HomeMaxx Pro; backups are purged on a rolling schedule.
7. Security
We protect information with encryption in transit, encrypted storage with our hosting providers, company-scoped access controls in HomeMaxx Pro, one-time codes instead of passwords for the portal, and audit logging of sensitive actions. No system is perfectly secure; tell us right away at the address below if you believe an account has been compromised.
8. Your choices and rights
You can opt out of texts by replying STOP, and of marketing emails through the link in the email. You can update your HomeMaxx Pro profile in the app and your portal contact details in the portal. Depending on where you live, you may have the right to access, correct, delete or receive a copy of your personal information, to object to or restrict certain processing, and to not be discriminated against for exercising those rights. To make a request, contact us using the details below; we will verify your identity and respond within the time the law allows. If the information is held by a Contractor as your service provider, we will refer your request to them or help you reach them.
California residents: we do not sell or share personal information for cross-context behavioral advertising, and we honor the rights described above under the CCPA/CPRA. Residents of other states with privacy laws have similar rights.
9. Children
The Services are for adults. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us information, contact us and we will delete it.
10. International users
The Services are operated from the United States and Puerto Rico and are intended for use there. If you use them from elsewhere, your information will be transferred to and processed in the United States.
11. Changes
We may update this policy. The current version and its date are always posted at homemaxx.pro/privacy. Material changes will be announced in the Services or by email.
